The Tragic Story of Timothy Ferguson: A Report on Child Welfare and the Sustainable Development Goals

Introduction

The story of a 15-year-old boy tortured to death is horrific.

Timothy Ferguson was living in a hellish nightmare during his final six months alive in West Michigan.

He suffered unimaginable forms of punishment at the hands of his mother and older brother. He was subjected to hours-long ice baths and force-fed some of the hottest hot sauce in the world.

Background

Timothy died July 6, 2022, in a home in Norton Shores, a Lake Michigan city of 25,000. He lived with a mother he was not supposed to be around, except for limited supervised visits.

He weighed 69 pounds when his mother, Shanda Vander Ark, found Timothy dead in a closet that morning. Shanda orchestrated the brutal punishments while her older son, Paul Ferguson, served as the enforcer in the abuse. Following their criminal convictions, Timothy’s mother and older brother Paul are serving long sentences in prison.

Sustainable Development Goals and Child Welfare

1. Scrutiny of Timothy’s Family in Oklahoma

Oklahoma’s Department of Human Services investigated the Ferguson family home nine times in an 11-year timeframe spanning from 2008 to 2019. In two of those nine investigations, authorities took action.

Allegations in six separate investigations were deemed unsubstantiated. In one instance, the agency made a ruling of failure to cooperate after Eric and Shanda refused to let social workers into their home.

2. Reunification as the Goal

In Oklahoma child welfare cases, the primary purpose behind almost every decision is doing what is in the best interest of the child. Absent the most extreme circumstances, the initial goal is almost always reunification so long as it can be safely accomplished and is in the child’s best interest.

Once reunification is the identified case plan goal, DHS creates a plan for parents to follow so they may demonstrate that any risks which caused the child to come into custody are eliminated and protective capacities are in place.

3. Eric’s Efforts to Regain Custody

When Eric and Shanda lost custody of their children in 2009, each parent took a different route in the reunification process.

Eric showed he was capable of establishing and maintaining boundaries for his children in order to keep them safe. He participated and completed parenting and counseling courses that led to reunification with his children.

4. Call for Investigation in Oklahoma

Shanda and Paul were both tried and convicted for Timothy’s death. Timothy’s sister, Millie, believes officials in Oklahoma should investigate how Timothy ended up with Shanda, who didn’t have custody and was only allowed supervised visits.

5. Timothy’s Multiple Living Environments

For a child, Timothy bounced around a lot. He was under five different scenarios of care in his 15 years.

From birth until he was 3, Timothy was in Eric and Shanda’s custody. That was until Oklahoma Department of Human Services investigated the couple in 2009 and removed Timothy and his three siblings from the parents’ custody. He spent the next two-and-a-half years in foster care.
