Definitions
In these Terms and Conditions, “Campaign Organizers” refers to those raising funds through Campaigns, and “Donors” refers to those contributing funds through Donations. The Services are offered as a platform for Users to create Campaigns and make Donations. The Company reserves the right to modify or discontinue the Services at any time without notice.
Services
- The Services allow Campaign Organizers to post Campaigns and accept Donations from Donors.
- A portion of each Donation will be charged as fees for the Services and third-party payment processors.
- The Company is not responsible for the deletion or failure to store any data or content uploaded by Users.
- Users may be charged standard wireless service carrier fees for accessing the Services through a mobile device.
Charitable Giving
Campaigns are not tax-deductible charities. Donations made through the Platform may be processed by an unaffiliated business partner, and processing fees will be deducted. The Company does not solicit charitable donations for itself or any third-party charitable institution.
Administrative Platform Only
The Company acts as a payment facilitator between Campaign Organizers and Donors. The Company is not a party to any agreement between Campaign Organizers and Donors and disclaims all liability in this regard. The Company does not guarantee the success or outcome of any Campaign and is not responsible for the quality, safety, or legality of any Campaign.
No Verification of Campaign Information
The Company does not verify the information provided by Campaign Organizers and does not guarantee that Donations will be used as promised. The Company disclaims any responsibility to verify whether Donations are used in accordance with applicable laws.
Your Registration Obligations
Users may be required to register with the Company to access certain features of the Services. Registration requires providing accurate and complete information. Users under 13 years of age are not authorized to use the Services. Users under 18 years of age may use the Services with the approval of a parent or guardian. Certain Services may require registration with third-party service providers.
Public Display of Donations
Donors have the option to publicly display their Donations or provide their information to the Campaign beneficiary. To keep Donation details private, Donors can select the appropriate checkbox during the Donation process.
Payment of Donations
Donors must provide valid payment information to contribute to a Campaign. Donors agree to pay the specified Donation amount and authorize the Company to bill their credit cards or payment methods. Donations are final and non-refundable.
Fees
The Company retains a portion of each Donation as a FrontRunner Professional Fee. Third-party payment processors charge additional processing fees. The specific fees are outlined for US and CA Users.
- US Users: 2.9% + $0.30 per donation for VISA, MasterCard, or Discover cards; 3.4% + $0.30 per donation for American Express cards.
- CA Users: 2.9% + $0.30 per donation for VISA, MasterCard, or Discover cards; 3.4% + $0.30 per donation for American Express cards.
All fees are deducted directly from each Donation and are not reflected in the amount available for Campaign Organizers to withdraw. The Company reserves the right to change the fees with notice.
Indemnification
You agree to release and hold the Company and its affiliates harmless from any losses, damages, expenses, claims, causes of action, and injury arising from your use of the Services or violation of these Terms and Conditions.
Disclaimer of Representations and Warranties
The Services are provided on an “as is” and “as available” basis. The Company and its affiliates disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, title, and non-infringement. The Company does not guarantee the accuracy, reliability, or quality of the Services.
Limitation of Liability
The Company and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the Services. The Company’s total liability to you will not exceed the amount you have paid in the last six months, but not more than one hundred dollars ($100).
Dispute Resolution – Arbitration
All disputes and claims between you and the Company will be resolved through arbitration. Either party may bring an individual action in small claims court. The arbitration will be governed by the AAA Rules and administered by the AAA. The arbitrator’s decision will be binding, and each party agrees to bring claims only in their individual capacity.
